Purpose and lawful basis
When you apply to us to buy or acquire your home under the Right to Buy and Right to Acquire schemes we will need to process your information in order to assess your eligibility and progress your application through to completion.
We will need to collect and process information supplied on your application form such as name, address and household details. We wil also need to collect certain supporting documents such as your tenancy agreement, photo i.d., council tax and utility bills.
In order to check your affordability we will run a basic credit check on all applicants.
The information collected and processed under your application is necessary in order for us to comply with our legal obligations under the Housing Act 1985 (for Right to Buy applications) and the Housing (Right to Acquire) Regulations 1997.
For both schemes we have a duty to ensure that you are eligible and that the application is not fraudulent, therefore we also process your information in accordance with our obligations under the Fraud Act 2006.
How long we keep it
We will keep records relating to your purchase for a period of 12 years.
If the purchase does not progress we will retain your application and associated documents for a period of 2 years.
Your rights
You have the right to access your personal data held in your application file by us. (Access)
You also have the right to have inaccurate data corrected and incomplete data completed. (Rectification)
You have the right to request us to pause the use of your data only if you have contested the accuracy whilst we verify your application or to stop it’s deletion in the case of a legal claim. (Restriction)
Who do we share the information with?
In order to provide progress your applications, it is necessary for us to share your information with the following types of organisations:
- Approved Surveyors to carry out a valuation on your property
- Yours and our solicitors
- National Leaseplan
Equifax will be used to process basic credit checks.
International Transfers
None of your information will be transferred outside of the UK for this purpose.
